IPC 420 in BNS: Cheating is Now Section 318

IPC 420 became so well known that '420' entered everyday language for a cheat. Under the new code, cheating and dishonestly inducing delivery of property is Section 318(4) of the Bharatiya Nyaya Sanhita, 2023.

Punishment under BNS 318(4)

The punishment remains imprisonment which may extend to seven years, and a fine. The BNS also consolidates the definition and grades of cheating within Section 318, so related sub-clauses now sit together in one place.

Practical drafting note

In cheque-fraud and property-fraud complaints it is common to pair cheating with other provisions such as criminal breach of trust (now BNS 316) or forgery (now BNS 336). Map every old section on the complaint to its BNS equivalent so the new FIR is internally consistent.
